Terms of Service

These Terms of Service ("Terms") govern your use of the RefCase Browser Extension, web application, and related services (collectively, the "Service") operated by RefCase ("we", "our", or "us").

 

By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

 

 

1. Description of the Service

 

RefCase provides a software platform designed to help sales professionals access, manage, and share customer reference cases and related information.

The Service may include:

  • A Chrome browser extension

  • A web application dashboard

  • Customer reference case management tools

  • Data upload and search functionality

  • Company matching functionality (Magic Match)
     

We may update, improve, or modify the Service at any time.​

2. Eligibility

 

You must be at least 18 years old to use the Service.

By using RefCase, you represent that:

  • You have the legal authority to enter into these Terms

  • You are using the Service for lawful business purposes

  • You will comply with all applicable laws and regulations

3. User Accounts

 

To access certain features of the Service, you must create an account.

Accounts may be created through third-party authentication providers including:

  • Google

  • Microsoft
     

You agree to:

​

  • Provide accurate account information

  • Maintain the security of your account

  • Notify us immediately of unauthorized use
     

You are responsible for all activity that occurs under your account.

4. Customer Data and Uploaded Content

 

Users may upload customer reference information into the Service.

You retain ownership of the data you upload.

However, by uploading data you grant RefCase a limited license to:

​

  • Store the data

  • Process the data

  • Display the data within the Service

  • Use the data to provide product functionality
     

You represent that you have the legal right to upload and process the data.

You agree not to upload content that:

​

  • Violates privacy laws

  • Infringes intellectual property rights

  • Contains unlawful or harmful material

  • Includes confidential information without authorization
     

RefCase does not verify the accuracy or legality of uploaded data.

5. Acceptable Use

​

You agree not to use the Service to:

​

  • Violate any law or regulation

  • Attempt to gain unauthorized access to systems

  • Reverse engineer the Service

  • Scrape or extract data from the platform without permission

  • Disrupt or interfere with the Service

  • Upload malicious software
     

We reserve the right to suspend or terminate accounts that violate these rules.

6. Magic Match Feature

 

RefCase includes a feature that allows users to analyze the domain of the website they are currently visiting to identify potential matching reference cases.

​

This feature only operates when activated by the user.

RefCase does not monitor or store complete browsing history.

Users are responsible for ensuring they comply with applicable privacy and data protection laws when using this feature.

7. Intellectual Property

 

All intellectual property rights in the Service remain the property of RefCase or its licensors.

This includes:

​

  • Software

  • Code

  • Design

  • Branding

  • Documentation
     

Users may not copy, modify, distribute, or reproduce any part of the Service without written permission.

8. Service Availability

 

We aim to provide a reliable service but do not guarantee uninterrupted availability.

The Service may occasionally experience:

​

  • Maintenance

  • Technical failures

  • Service interruptions
     

We are not liable for downtime or service disruptions.

9. Disclaimer of Warranties

 

The Service is provided "as is" and "as available."

To the fullest extent permitted by law, RefCase disclaims all warranties including:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy of data
     

We do not guarantee that the Service will meet your requirements or operate without errors.

10. Limitation of Liability

 

To the maximum extent permitted by law, RefCase shall not be liable for:

  • Indirect damages

  • Loss of business

  • Loss of data

  • Loss of revenue

  • Consequential damages
     

Our total liability for any claim relating to the Service shall not exceed the amount paid by the user to RefCase in the previous 12 months.

11. Termination

 

We may suspend or terminate accounts if:

  • These Terms are violated

  • The Service is misused

  • Required by law
     

Users may stop using the Service at any time.

Upon termination, access to the Service may be revoked.

12. Changes to the Terms

 

We may update these Terms periodically.

When changes occur:

  • The updated version will be posted on our website

  • The "Last updated" date will change
     

Continued use of the Service means acceptance of the updated Terms.

13. Governing Law

 

These Terms of Service and any dispute arising out of or related to the use of the Service shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles.

The place of jurisdiction for all disputes arising from or in connection with these Terms shall be Düsseldorf, Germany, to the extent permitted by applicable law.

If the user is a consumer within the meaning of applicable consumer protection laws, mandatory consumer protection provisions of the country in which the consumer resides remain unaffected.
